RE: The tariff classification of a sewing kit from China.

Dear Mr. Crago:

In your letter dated December 11, 2007, you requested a tariff classification ruling.

You have submitted a sample of a sewing kit, model H011AA01089. It will be returned to you as requested. The kit is housed in a plastic box which makes it suitable for travel. The kit consists of 9 spools of thread, a plastic thimble, mini scissors, 8 plastic buttons, 3 snaps, a threader, 5 sewing needles, 4 safety pins and a measuring tape.

The applicable subheading for the sewing kit will be 9605.00.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Travel sets for personal toilet, sewing or shoe or clothes cleaning”. The rate of duty will be 8.1% ad valorem.

You ask whether a visa is required for the polyester sewing thread. Since it is classified as a travel set, a visa is not required for the thread.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
